١. قبول الشروط

باستخدامك تطبيق SeaSaleKw ("التطبيق")، فإنك تقر بأنك قرأت هذي الشروط وفهمتها ووافقت على الالتزام بها. إذا ما توافق عليها، لا تستخدم التطبيق.

٢. الأهلية

• التصفح: متاح لمن بلغ ١٢ سنة فأكثر.
• إنشاء حساب ونشر الإعلانات والتواصل: مقصور على من بلغ ١٨ سنة فأكثر ويملك الأهلية القانونية للتعاقد.

ببدء استخدام أي من هذي الخدمات فأنت تقر بأنك مستوفٍ لشرط السن.

٣. طبيعة الخدمة — اقرأ هذا البند بعناية

كل صفقة تتم بينك وبين الطرف الآخر مباشرة وعلى مسؤوليتكما وحدكما. أنت وحدك المسؤول عن التحقق من السلعة وأوراقها وحالتها قبل الدفع أو التسليم.

نصائح سلامة نوصي بها بشدة

• عاين القارب أو المعدة على الطبيعة قبل أي دفع.
• التقِ في مكان عام ومضاء ونهاراً، ويفضّل بحضور شخص معك.
• تأكد من أوراق ملكية القارب ورقم الهيكل قبل الشراء.
• احذر من يطلب عربوناً أو تحويلاً قبل المعاينة — هذي أشهر صورة للاحتيال.
• لا تشارك كلمة مرورك أو رابط استعادة حسابك مع أي شخص إطلاقاً.

٤. حسابك

• تلتزم بتقديم بيانات صحيحة، وبتحديثها إذا تغيّرت.
• أنت مسؤول عن كل نشاط يتم عبر حسابك، وعن الحفاظ على سرية وسائل الدخول.
• يُمنع إنشاء أكثر من حساب لتجاوز حدود النشر أو للتحايل على إيقاف سابق.
• يُمنع انتحال شخصية أي فرد أو جهة.

٥. قواعد نشر الإعلانات

• اختر القسم الصحيح لإعلانك قبل النشر. الإعلان بالقسم الخطأ يُحذف.
• الصور لازم تكون حقيقية وللسلعة نفسها — لا صور مأخوذة من الإنترنت ولا صور لسلعة مختلفة.
• الوصف والسعر لازم يكونان صحيحين وغير مضللين.
• يُمنع تكرار الإعلان نفسه، أو إعادة نشره لرفعه بالنتائج.
• يُمنع نشر إعلانات لسلع لا تملكها أو غير مخوّل ببيعها.
• حد الصور: ١٠ صور لكل إعلان — عدا قسم مطلوب قوارب فصورة واحدة.

٥.١ مدة الإعلان والحدود المجانية

الحدود الثلاثة مستقلة تماماً، فالحد الأقصى للحساب الواحد هو ٩ إعلانات في الشهر.

• بعد انتهاء المدة ينتقل الإعلان تلقائياً إلى الأرشيف داخل حسابك، محفوظاً بكل بياناته وصوره.
• إعادة النشر من الأرشيف تُحسب إعلاناً جديداً وتستهلك من رصيدك المجاني.
• حذف الإعلان لا يعيد لك الرصيد المستهلك. الرصيد يُحسب على أساس عدد مرات النشر لا عدد الإعلانات القائمة.
• لكن إذا رفضنا إعلانك، يُعاد لك الرصيد تلقائياً — حتى ٣ مرات في الشهر. بعد الرفض الثالث ما يُعاد الرصيد، لمنع استنزاف المراجعة.
• قد نعدّل هذي الحدود مستقبلاً، ويُعلن عن التعديل داخل التطبيق قبل سريانه.

٥ مكرر. خدمة حالة البحر — إخلاء مسؤولية

• لا نتحمّل أي مسؤولية — مباشرة أو غير مباشرة — عن أي ضرر أو خسارة أو إصابة أو وفاة تنتج عن الاعتماد على هذي البيانات.
• قرار الإبحار من عدمه مسؤوليتك وحدك، وعليك الرجوع للجهات الرسمية المختصة قبل أي رحلة بحرية.
• لا نضمن استمرارية الخدمة ولا دقتها ولا توفّرها، ويحق لنا تعديلها أو إيقافها بأي وقت.

٥ ثالثاً. البانرات الإعلانية

قد يعرض التطبيق بانراً إعلانياً واحداً بالصفحة الرئيسية وآخر بصفحة حالة البحر، لشركات محلية، وكل بانر مُعلَّم بكلمة «إعلان».

• عرض البانر ليس تزكية ولا توصية من SeaSaleKw للشركة المعلنة ولا لسلعها ولا لخدماتها.
• أي تعامل بينك وبين الشركة المعلنة يتم خارج التطبيق وعلى مسؤوليتك وحدك، ولا نتحمل عنه أي مسؤولية.
• الإعلانات غير مُخصّصة — كل المستخدمين يشوفون البانر نفسه، وما نستخدم بياناتك لاختياره.
• نحتفظ بحقنا في رفض أو سحب أي إعلان بلا إبداء أسباب.

٦. السلع والخدمات الممنوعة

يُمنع منعاً باتاً عرض أي من السلع أو الخدمات الواردة في قائمة السلع الممنوعة، وهي جزء لا يتجزأ من هذي الشروط. مخالفة هذا البند تؤدي لحذف الإعلان وإيقاف الحساب فوراً، وقد نبلّغ الجهات المختصة.

٧. السلوك المحظور

• الاحتيال أو محاولة الاحتيال بأي صورة.
• التحرش أو التهديد أو الإساءة أو خطاب الكراهية.
• المحتوى الإباحي أو المخالف للآداب العامة أو للنظام العام في دولة الكويت.
• الرسائل الدعائية المزعجة داخل الدردشة.
• جمع بيانات المستخدمين أو أرقامهم بأي وسيلة آلية.
• محاولة اختراق التطبيق أو تعطيله أو الالتفاف على قيوده.

٨. الإبلاغ والإشراف على المحتوى

٨.١ مراجعة كل إعلان قبل نشره

• نقرأ عنوان الإعلان ووصفه، ونطّلع على صوره وقسمه، للتأكد من مطابقته لهذي الشروط ولقائمة الممنوعات.
• نوافق أو نرفض، ويصلك القرار بإشعار داخل التطبيق مع بيان سبب الرفض.
• الإعلان المرفوض تقدر تعدّله وتعيد إرساله.
• رصيدك المجاني يُستهلك عند الإرسال للمراجعة لا عند القبول — لمنع استنزاف المراجعة بإرسال متكرر بلا كلفة. راجع البند ٥.١.

٨.٢ الفلترة الآلية

قبل المراجعة البشرية، نطبّق فلترة آلية على نصوص الإعلانات والرسائل. المحتوى اللي يخالف قائمة الممنوعات أو يتضمن ألفاظاً نابية يُرفض تلقائياً ولا يُنشر. محاولة الالتفاف على هذي الفلترة بتحوير الكلمات أو تقطيعها مخالفة توجب إيقاف الحساب.

٨.٣ البلاغات

يوفر التطبيق زر إبلاغ على كل إعلان وكل محادثة، وإمكانية حجب أي مستخدم. نراجع البلاغات ونسعى للرد عليها خلال ٢٤ ساعة.

٨.٤ حذف الإعلان وحظر الحساب

نحتفظ بحقنا الكامل — دون إشعار مسبق ودون إبداء أسباب — في: حذف أي إعلان أو محتوى، تعليق أو إنهاء أي حساب، والامتناع عن تقديم الخدمة لأي مستخدم يخالف هذي الشروط أو يعرّض سلامة المستخدمين للخطر.

عند حذف إعلانك من الإدارة، يرجع الإعلان لأرشيف حسابك مع بيان سبب الحذف.

٩. تمييز الإعلان والخدمات المدفوعة

• تُشترى خدمات التمييز حصراً عبر متجر التطبيقات الرسمي الذي نزّلت منه التطبيق.
• الأسعار معروضة داخل التطبيق قبل الشراء، وقد تتغير مستقبلاً دون أثر رجعي على مشترياتك السابقة.
• الاسترداد يخضع لسياسات متجر التطبيقات، وهو من يتولاه. نحن لا نستقبل ولا نعالج طلبات الاسترداد.
• التمييز يرفع ظهور إعلانك فقط، ولا يضمن بيع السلعة ولا عدداً معيناً من المشاهدات أو المشترين.
• إذا حُذف إعلانك لمخالفته هذي الشروط، لا يُستحق أي استرداد عن مبلغ التمييز.

١٠. الملكية الفكرية

اسم SeaSaleKw وشعاره وتصميم التطبيق ومحتواه ملك لنا ومحمية قانوناً. يُمنع استخدامها دون إذن كتابي.

أما المحتوى اللي تنشره أنت (الصور والأوصاف) فيبقى ملكك، لكنك تمنحنا بنشره ترخيصاً غير حصري ومجانياً لعرضه وتخزينه وتقديمه داخل التطبيق وفي مواد التعريف بالتطبيق، ويستمر هذا الترخيص حتى حذف المحتوى.

أنت تقر بأنك تملك حقوق الصور اللي ترفعها أو مخوّل باستخدامها.

١١. إخلاء المسؤولية

يُقدَّم التطبيق "كما هو" ودون أي ضمانات صريحة أو ضمنية. لا نضمن استمرارية الخدمة دون انقطاع أو خلوها من الأخطاء.

لا نتحمل أي مسؤولية عن: أي خسارة أو ضرر ناتج عن صفقة بين مستخدمين، أو عن دقة أي إعلان، أو عن سلوك أي مستخدم، أو عن انقطاع الخدمة، أو عن فقد بيانات لأسباب خارجة عن إرادتنا.

وفي جميع الأحوال، لا تتجاوز مسؤوليتنا الإجمالية تجاهك المبلغ اللي دفعته لنا فعلياً خلال الاثني عشر شهراً السابقة للواقعة.

١٢. التعويض

توافق على تعويضنا والدفاع عنا ضد أي مطالبة أو خسارة أو مصاريف قانونية تنشأ عن مخالفتك لهذي الشروط أو للقوانين، أو عن محتوى نشرته، أو عن صفقة أجريتها عبر التطبيق.

١٣. إنهاء الاستخدام

تقدر تحذف حسابك بأي وقت من: الحساب ← الإعدادات ← حذف الحساب. ونقدر نوقف حسابك عند مخالفة هذي الشروط. تظل بنود إخلاء المسؤولية والتعويض والقانون الحاكم سارية بعد الإنهاء.

بعد الحذف، ما تقدر تسجّل حساباً جديداً بنفس البريد الإلكتروني قبل مرور ١٤ يوماً. تفاصيل ما نحتفظ به خلال هذي المدة بـسياسة الخصوصية.

١٤. تعديل الشروط

قد نعدّل هذي الشروط. عند أي تعديل جوهري نبلغك داخل التطبيق قبل سريانه. استمرارك بالاستخدام بعد ذلك يعني قبولك للنسخة المعدّلة.

١٥. القانون الحاكم

تخضع هذي الشروط وتُفسَّر وفقاً لقوانين دولة الكويت، وتختص المحاكم الكويتية دون غيرها بنظر أي نزاع ينشأ عنها.

1. Acceptance

By using SeaSaleKw ("the App") you confirm that you have read, understood and agree to be bound by these Terms. If you do not agree, do not use the App.

2. Eligibility

• Browsing: available to users aged 12 and over.
• Creating an account, posting listings and contacting users: restricted to users aged 18 and over with legal capacity to contract.

3. Nature of the service — read carefully

Every transaction is directly between you and the other party, at your own risk. You alone are responsible for verifying the item, its documents and its condition before paying or handing over.

Safety guidance we strongly recommend

• Inspect the boat or equipment in person before any payment.
• Meet in a public, well-lit place during daylight, preferably with someone else present.
• Verify boat ownership papers and hull number before purchase.
• Beware of anyone requesting a deposit or transfer before inspection — the most common scam pattern.
• Never share your password or account-recovery link with anyone.

4. Your account

• Provide accurate information and keep it up to date.
• You are responsible for all activity under your account and for keeping your credentials confidential.
• Creating multiple accounts to bypass listing limits or a previous suspension is prohibited.
• Impersonating any person or entity is prohibited.

5. Listing rules

• Select the correct category before publishing. Miscategorised listings are removed.
• Photos must be genuine and of the actual item — no images taken from the internet or of a different item.
• Descriptions and prices must be accurate and not misleading.
• Duplicate listings and re-posting to gain ranking are prohibited.
• Do not list items you do not own or are not authorised to sell.
• Photo limit: 10 per listing — except Boats Wanted, which allows one.

5.1 Listing duration and free limits

The three allowances are fully independent, so the maximum per account is 9 listings per month.

• On expiry, the listing moves automatically to the Archive in your account, preserved with all its data and photos.
• Re-publishing from the Archive counts as a new listing and consumes your free allowance.
• Deleting a listing does not restore consumed allowance. Allowance is counted by number of times published, not by listings currently live.
• If we reject your listing, however, the allowance is refunded automatically — for up to 3 rejections per month. Beyond the third, no refund is given, to prevent review capacity being drained.
• We may change these limits in future; changes will be announced in the App before taking effect.

5-bis. Sea Conditions service — disclaimer

• We accept no liability — direct or indirect — for any damage, loss, injury or death arising from reliance on this data.
• The decision to put to sea is yours alone; consult the competent official authorities before any voyage.
• We do not guarantee the continuity, accuracy or availability of the service, and may modify or discontinue it at any time.

5-ter. Advertising banners

The App may display one advertising banner on the Home screen and one on the Sea Conditions screen, for local businesses. Each banner is labelled "Ad".

• Displaying a banner is not an endorsement by SeaSaleKw of the advertiser, its goods or its services.
• Any dealing between you and an advertiser takes place outside the App, at your sole risk, and we accept no responsibility for it.
• Ads are not personalised — every user sees the same banner, and we do not use your data to select it.
• We reserve the right to refuse or withdraw any advertisement without giving reasons.

6. Prohibited items and services

Listing anything on our Prohibited Items list is strictly forbidden. That list forms an integral part of these Terms. Violations result in immediate listing removal and account suspension, and may be reported to the competent authorities.

7. Prohibited conduct

• Fraud or attempted fraud of any kind.
• Harassment, threats, abuse or hate speech.
• Pornographic content or content contrary to public morals or public order in Kuwait.
• Unsolicited promotional messages in chat.
• Harvesting user data or phone numbers by any automated means.
• Attempting to hack, disrupt or circumvent the App's restrictions.

8. Reporting and moderation

8.1 Every listing is reviewed before publication

• We read the title and description and look at the photos and chosen category, to confirm the listing meets these Terms and our Prohibited Items list.
• We approve or reject, and you receive the decision as an in-app notification stating the reason for any rejection.
• A rejected listing can be edited and resubmitted.
• Your free allowance is consumed when a listing is submitted for review, not when it is approved — this prevents repeated submissions from draining review capacity at no cost. See clause 5.1.

8.2 Automated filtering

Before human review, we apply automated filtering to listing and message text. Content that breaches our Prohibited Items list or contains abusive language is rejected automatically and never published. Attempting to evade this filter by altering or splitting words is a violation and grounds for account suspension.

8.3 Reports

The App provides a report button on every listing and conversation, and the ability to block any user. We review reports and aim to respond within 24 hours.

8.4 Listing removal and account bans

We reserve the right, without prior notice and without stating reasons, to remove any listing or content, suspend or terminate any account, and refuse service to any user who violates these Terms or endangers user safety.

When we remove your listing, it returns to your account archive with the reason for removal stated.

9. Featured listings and paid services

• Featuring services are purchased exclusively through the official app store you downloaded the App from.
• Prices are shown in-App before purchase and may change in future without retroactive effect.
• Refunds are governed and handled solely by the app store. We do not receive or process refund requests.
• Featuring increases visibility only; it does not guarantee a sale or any number of views or buyers.
• If your listing is removed for violating these Terms, no refund is due for any featuring fee.

10. Intellectual property

The SeaSaleKw name, logo, App design and content are our property and legally protected. Use without written permission is prohibited.

Content you post (photos and descriptions) remains yours. By posting it you grant us a non-exclusive, royalty-free licence to display, store and present it within the App and in App promotional materials, lasting until you delete the content.

You confirm that you own or are authorised to use the images you upload.

11. Disclaimer

The App is provided "as is" without warranties of any kind, express or implied. We do not warrant uninterrupted or error-free service.

We accept no liability for any loss or damage arising from a transaction between users, the accuracy of any listing, the conduct of any user, service interruption, or data loss beyond our control.

In all cases, our total liability to you shall not exceed the amount you actually paid us in the twelve months preceding the event.

12. Indemnity

You agree to indemnify and defend us against any claim, loss or legal cost arising from your breach of these Terms or of applicable law, from content you posted, or from a transaction you conducted through the App.

13. Termination

You may delete your account at any time via Account → Settings → Delete Account. We may suspend your account for breach of these Terms. The disclaimer, indemnity and governing-law clauses survive termination.

After deletion, you cannot register a new account with the same email address for 14 days. What we retain during that period is described in the Privacy Policy.

14. Changes to these Terms

We may amend these Terms. For material changes we will notify you in the App before they take effect. Continued use thereafter constitutes acceptance.

15. Governing law

These Terms are governed by and construed in accordance with the laws of the State of Kuwait, and the Kuwaiti courts have exclusive jurisdiction over any dispute arising from them.
